Website and Event Terms and Conditions

These Terms and Conditions apply to:

1. the website, registration system and related communications operated by Ashley Simons;
2. gaming sessions, tournaments, social gatherings and other events organised by Ashley Simons; and
3. attendance at any venue or private residence used for an event.

In these Terms, “Ashley Simons,” “the organiser,” “I,” “me” and “my” refer to Ashley Simons.

“Participant” means anyone who registers for, attends, competes in, accompanies another person to, or otherwise takes part in an event.

By using the website, registering for an event or attending an event, you agree to these Terms.

1. Eligibility and registration

Unless an event listing expressly states otherwise, events are intended for people aged 18 years or older.

You must provide accurate and reasonably complete registration information. You must not register using another person’s identity or provide contact details that you are not authorised to use.

Registration does not guarantee admission. Attendance may be limited because of venue capacity, equipment availability, safety considerations or other reasonable operational requirements.

Tickets and registrations may not be resold or transferred without the organiser’s approval.

2. Personal information

The organiser may collect information reasonably required to organise and operate events, including:

• your name;
• your email address and telephone number;
• your gamertag, online identity or preferred display name;
• registration, attendance and payment information;
• game and tournament preferences;
• communications between you and the organiser; and
• emergency or accessibility information that you voluntarily provide.

This information may be used to:

• process registrations and payments;
• communicate event details and changes;
• manage attendance, brackets, matches and results;
• maintain event safety and respond to incidents;
• improve future events; and
• comply with legal, insurance or venue requirements.

The organiser will take reasonable steps to protect personal information from unauthorised access, loss, misuse or disclosure. However, no website, database or electronic communication system can be guaranteed to be completely secure.

Personal information will not be sold as a standalone asset or for data-brokering, advertising or unrelated marketing purposes. However, if the whole HipBlox product, service or business is sold, transferred or acquired, personal information may be transferred to the new owner as part of that transaction. Where reasonably possible, the organiser will require the new owner to handle that information under these terms or terms that provide materially equivalent protections.

Service providers may be used to host the website, process payments, deliver email or SMS messages, manage registrations or otherwise support an event. Those providers may process information on the organiser’s behalf according to their own applicable terms and privacy practices.

You may contact the organiser at ashley@hipblox.club to request access to or correction of your information, or to ask that information no longer reasonably required be deleted.

Information may be retained where reasonably required for taxation, accounting, dispute resolution, safety, insurance or legal purposes.

3. Public display of names, gamertags and results

When registering, you may be asked to choose how you are publicly identified.

With your consent, the organiser may publish or display:

• your gamertag;
• your first name;
• your first name and surname initial;
• your tournament placement, match results or scores; and
• the fact that you are attending or have attended an event.

This information may appear on the website, registration lists, tournament brackets, score displays, social media posts or event communications.

The organiser will not intentionally publish your full legal name, email address, telephone number or home address unless:

1. you have specifically agreed;
2. publication is reasonably required by law; or
3. disclosure is necessary to respond to a serious safety issue.

You may ask for a publicly displayed name or gamertag to be changed or removed. Reasonable steps will be taken to do so, although removal from search engines, screenshots, reposts, archives or materials controlled by other people may not always be possible.

4. Private residential events

Some events may take place at a private residence.

A residential address is provided only to confirmed invitees for the purpose of attending the relevant event.

Participants must not:

• publish, repost or distribute the address publicly;
• invite or bring an unregistered person without permission;
• use the address for any unrelated purpose;
• photograph or record private areas of the property;
• enter bedrooms, offices, storage areas or other restricted areas; or
• return to the property outside the event without express permission.

Participants must respect the residents, neighbours, property, pets and any instructions concerning parking, noise, smoking, food, bathrooms or restricted spaces.

Disclosure or misuse of a private address may result in immediate removal, cancellation of future registrations and, where appropriate, referral to police or another authority.

5. Participant conduct

Events are intended to provide a safe, respectful and welcoming gaming environment.

Participants must behave respectfully toward the organiser, venue staff, residents, spectators and other participants.

The following conduct is not permitted:

• violence, threats, intimidation or aggressive behaviour;
• harassment, bullying, stalking or unwanted sexual attention;
• discrimination or degrading conduct based on personal characteristics;
• deliberate disruption of games, brackets, equipment or the event;
• cheating, collusion, match manipulation or knowingly exploiting an administration error;
• theft, deliberate property damage or unauthorised use of property;
• dangerous behaviour, including running through equipment areas or interfering with electrical cables;
• recording another person in a private, humiliating or harassing context;
• bringing weapons, illegal drugs or dangerous items;
• attending while so intoxicated or impaired that you create a safety or behavioural risk; or
• refusing a reasonable instruction concerning safety, venue management or event administration.

Friendly competitive banter is acceptable only while everyone involved is comfortable with it. A participant must stop when asked.

6. Alcohol, smoking and substances

Alcohol is permitted only where expressly authorised by the event listing, venue, host and applicable law.

Participants must not supply alcohol to a minor.

A participant who appears intoxicated, impaired, aggressive or unsafe may be refused entry or required to leave.

Smoking and vaping are permitted only in areas designated by the venue or host.

Illegal drugs are prohibited.

7. Equipment and personal belongings

Participants may be allowed to bring consoles, arcade sticks, controllers, monitors, cables or other equipment with prior approval.

You are responsible for:

• ensuring your equipment is safe and in reasonable condition;
• clearly identifying your property;
• installing and removing it as directed;
• supervising valuable belongings; and
• avoiding cables, adapters or modifications that could create a hazard or damage another device.

The organiser may refuse the use of equipment that appears unsafe, incompatible, damaged or disruptive.

To the maximum extent permitted by law, participants bring equipment and personal belongings at their own risk.

The organiser is not responsible for ordinary loss, theft or accidental damage unless it results from a failure to exercise reasonable care and liability cannot lawfully be excluded.

Participants must not intentionally or recklessly damage equipment belonging to the organiser, a venue, a resident or another participant.

8. Health, accessibility and safety

Participants must take reasonable care for their own safety and the safety of others.

Participants must:

• follow reasonable safety and emergency instructions;
• report spills, exposed cables, damaged equipment, hazards, injuries or threatening conduct promptly;
• use equipment only for its intended purpose;
• avoid attending when seriously unwell with a contagious illness;
• inform the organiser of accessibility requirements for which advance planning is reasonably necessary; and
• seek assistance rather than attempting an unsafe task.

Gaming events may involve extended sitting, bright or flashing images, screen motion, loud sounds, crowded rooms, electrical equipment and repetitive hand movements.

Participants should take breaks and make their own informed decisions about whether participation is appropriate for them.

Participants remain responsible for managing their own health conditions, medication, food allergies and dietary requirements.

Unless expressly stated otherwise, the organiser does not provide medical supervision, secure medication storage or allergen-free food preparation.

In an emergency, the organiser may contact emergency services and provide information reasonably necessary to assist them.

9. Removal and exclusion

The organiser may warn, remove, refuse entry to, suspend or ban a participant where the organiser reasonably believes this is necessary to:

• protect safety or wellbeing;
• respond to serious or repeated misconduct;
• protect a private residence or venue;
• prevent harassment, cheating or disruption;
• comply with venue requirements or law; or
• preserve the reasonable enjoyment of the event.

Where circumstances permit, the seriousness of the conduct will be considered and the participant may be given an opportunity to explain.

Immediate removal may occur where there is an urgent safety concern.

A participant removed for misconduct is not automatically entitled to a refund. This does not limit any non-excludable right under the Australian Consumer Law.

10. Event format and decisions

The organiser may establish rules concerning game versions, platforms, controllers, match length, brackets, seeding, lateness, disconnections, pauses and player conduct.

Participants must follow published event rules and reasonable rulings made by the organiser.

Reasonable changes may be made to event schedules, formats, equipment, games, brackets or venue arrangements.

Tournament rulings made in good faith are final for the purpose of running the event, but this does not prevent a participant from raising a genuine complaint.

11. Event cancellation, postponement and refunds

The organiser may cancel, postpone, relocate or modify an event because of insufficient registrations, illness, equipment failure, venue unavailability, weather, safety concerns or circumstances outside the organiser’s reasonable control.

Where an event is cancelled and no reasonable replacement date or equivalent service is provided, registered participants will ordinarily receive a refund of the affected event fee.

Where an event is postponed, the organiser may offer attendance on the new date, account credit or a refund, depending on the circumstances and any rights that apply under the Australian Consumer Law.

Unless an event listing states otherwise, participant-requested cancellations received after [insert cancellation deadline] may be non-refundable where costs have already been incurred or the place cannot reasonably be filled.

The organiser is not responsible for a participant’s incidental expenses, such as travel, accommodation, food or time away from work, except where liability cannot lawfully be excluded.

12. Photos, video and streaming

Notice will be provided where photography, video recording or streaming is planned.

General event footage may be captured for event reporting, community promotion and historical records.

Specific permission will be sought before deliberately featuring a participant in a posed photograph, interview or substantial promotional profile.

You may tell the organiser that you do not wish to be deliberately photographed or featured. Reasonable steps will be taken to respect that request, but it may not be possible to guarantee that a person will never appear incidentally in a wide crowd shot, background image or third-party recording.

Participants must not photograph, record or stream:

• a person who has reasonably asked not to be recorded;
• personal registration or contact information;
• private conversations;
• private areas of a residence;
• children without the permission of their parent or guardian; or
• conduct that would reasonably humiliate, harass or endanger another person.

Any livestreaming or commercial recording requires prior approval.

13. Assumption of ordinary risks

Participants acknowledge that attendance involves ordinary risks associated with travel, gathering with other people, using gaming and electrical equipment, carrying personal property and spending extended periods playing video games.

Participants agree to exercise reasonable care and follow safety instructions.

This clause does not require participants to accept risks created by unlawful conduct, reckless conduct or a failure by the organiser to take reasonable care.

This clause does not exclude any right that cannot lawfully be excluded.

14. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified.

Subject to those non-excludable rights, the organiser is not liable for:

• loss caused by a participant’s own conduct or failure to follow reasonable instructions;
• loss caused by another participant or an unrelated third party outside the organiser’s reasonable control;
• indirect or consequential loss that was not reasonably foreseeable;
• loss of opportunity, ranking, game progress or data;
• minor variations to event scheduling, brackets, games or equipment; or
• loss of or damage to unattended personal belongings where reasonable care was exercised.

Where liability for services may lawfully be limited, the organiser’s liability will be limited, at the organiser’s option, to:

1. supplying the affected service again; or
2. paying the reasonable cost of having the affected service supplied again.

Any monetary limitation in these Terms does not apply to liability for death or personal injury, fraud, wilful misconduct, or any other liability that cannot lawfully be limited.

15. Responsibility for damage and loss

A participant is responsible for loss or damage they directly cause through intentional, unlawful or seriously reckless conduct.

To the extent permitted by law, a participant agrees to reimburse the organiser for reasonable costs arising directly from:

• deliberate damage to property;
• theft;
• bringing an unauthorised guest;
• unlawful conduct; or
• a serious breach of these Terms.

This obligation does not apply to loss caused by the organiser, ordinary accidents that occurred despite reasonable care, or amounts that would make this clause unfair or unenforceable.

16. Complaints and incident reporting

Safety concerns should be reported to the organiser immediately.

Other complaints may be sent to ashley@hipblox.club and should include enough information for the issue to be understood and investigated.

The organiser will attempt to respond fairly and within a reasonable time.

Relevant registration records, messages, photographs, video, witness accounts or incident notes may be preserved while a complaint is investigated.

The identity of a complainant may be kept confidential where reasonably possible, but complete confidentiality cannot be promised where disclosure is required to investigate fairly, protect someone’s safety or comply with law.

17. Website availability and acceptable use

The organiser does not guarantee that the website will always be uninterrupted, error-free or available.

You must not:

• attempt to gain unauthorised access to the website or another user’s information;
• introduce malware or harmful code;
• scrape or harvest participant information;
• test website vulnerabilities without permission;
• impersonate another person;
• use information obtained through the website or an event to harass or spam someone; or
• interfere with the operation of the website.

Access may be suspended, errors may be corrected and material may be removed where reasonably necessary.

18. Electronic communications

By registering, you consent to receive operational communications relating to your registration or event, including confirmations, reminders, safety information, venue details and changes.

Marketing or invitations to unrelated future events will be sent only where permitted by law.

You may unsubscribe from promotional communications, but operational messages reasonably necessary to administer an existing registration may still be sent.

19. Changes to these Terms

These Terms may be updated from time to time.

The version applying to an event will ordinarily be the version presented when you register, except where a later change is reasonably necessary for safety, legal compliance or correction of an obvious error.

Material changes will be communicated where reasonably practicable.

20. Severability

If any part of these Terms is invalid or unenforceable, that part will be read down to the minimum extent necessary or removed.

The remaining provisions will continue to operate.

21. Governing law

These Terms are governed by the laws of South Australia and applicable Commonwealth laws.

The parties submit to the courts and tribunals having jurisdiction in South Australia, subject to any right a consumer has to bring a claim elsewhere.
